108. Cooperation between the Securities and Exchange Commission and other countries’ competent authorities.
(1) The Securities and Exchange Commission shall cooperate with the respective authorities of the member state where the secondary market, in which the AIF units are traded, operates, in a way that allows the Securities and Exchange Commission and the said authorities to effectively perform their supervisory duties.
(2) The listing of AIF units for trading in a secondary market of a third country prerequisites the existence of a memorandum of understanding or any other type of agreement ensuring the cooperation and exchange of information between the Securities and Exchange Commission and the competent authorities of the third country.
