18.112. Reliance on Service Providers
The Investment Compartment must rely upon the performance of service providers to perform certain functions, which may include functions that are integral to the Investment Compartment’s operations and financial performance. Failure by any service provider to carry out its obligations to the Investment Compartment in accordance with the terms of its appointment, to exercise due care and skill or to perform its obligations to the Investment Compartment at all as a result of insolvency, bankruptcy or other causes could have a material adverse effect on the Investment Compartment’s performance and returns to shareholders. The termination of the Investment Compartment’s relationship with any service provider, or any delay in appointing a replacement for such service provider, could materially disrupt the business of the Investment Compartment and could have a material adverse effect on the Investment Compartment’s performance and returns to shareholders.
